1. Scope of Application

  1. These Terms and Conditions apply to contracts for the rental provision of hotel rooms for accommodation purposes and for all other services provided by the hotel (hotel accommodation contract).
  2. The subletting or re-letting of the rooms provided, as well as their use for purposes other than accommodation, requires the prior consent of the hotel in text form.
  3. The customer’s own terms and conditions shall only apply if this has been expressly agreed in text form in advance.

2. Conclusion of Contract, Contracting Parties and Limitation Periods

  1. The hotel is free to confirm room bookings in text form.
  2. The contracting parties are the hotel and the customer. If a third party has made a booking on behalf of the customer, the third party shall be jointly and severally liable to the hotel together with the customer.
  3. All claims against the hotel shall generally become statute-barred one year after the commencement of the statutory limitation period. Claims for damages shall become statute-barred after five years. These shortened limitation periods shall not apply to claims based on an intentional or grossly negligent breach of duty by the hotel.

3. Services, Prices, Payment and Set-Off

  1. The hotel is obliged to provide the rooms booked by the customer and to render the agreed services.
  2. The customer is obliged to pay the hotel’s applicable prices for the provision of the rooms and for any additional services used by the customer. This also applies to services and expenses incurred by the hotel for third parties at the customer’s request. The agreed prices include the applicable statutory VAT.
  3. The hotel may make its consent to a subsequent reduction requested by the customer in the number of rooms booked, the hotel’s services or the duration of the customer’s stay conditional upon an increase in the price of the rooms and/or other hotel services.
  4. Hotel invoices are payable without deduction within 7 days of the invoice being sent. In the event of late payment, the hotel is entitled to charge a flat fee of €25.00 for late-payment and processing costs.
  5. The hotel is entitled to request an advance payment or security deposit from the customer upon conclusion of the contract.
  6. In justified cases, for example if the customer is in arrears with payment, the hotel is entitled to refuse further services.
  7. The customer may only set off or offset a claim against a claim of the hotel if the customer’s claim is undisputed or has been legally established.

4. Cancellation by the Customer (Cancellation and No-Show)

  1. Cancellation by the customer of a contract concluded with the hotel requires the hotel’s consent in text form. If such consent is not given, the agreed contractual price remains payable even if the customer does not make use of the contractual services.
  2. If the hotel and the customer have agreed in text form on a deadline for cancellation free of charge, the customer may cancel the contract up to that deadline without giving rise to payment or compensation claims by the hotel. The customer’s right of cancellation expires if the customer does not exercise this right vis-à-vis the hotel in text form by the agreed deadline.
  3. In the case of rooms not used by the customer, the hotel shall offset any income received from renting these rooms to other guests. If the rooms cannot be rented to other guests, the hotel may charge 100% of the contractually agreed remuneration.
  4. The right to cancel the contract concluded with the hotel expires two weeks before the contractually agreed arrival date.

Please note: Pursuant to Article 16 of Directive 2011/83/EU of the European Parliament, the 14-day right of withdrawal does not apply to hotel bookings. The hotel’s cancellation conditions apply.

5. Cancellation by the Hotel

  1. If it has been agreed in text form that the customer may cancel the contract free of charge within a certain period, the hotel is also entitled to cancel the contract during this period, for example if the customer fails to make a contractually agreed advance payment.
  2. In the event of a justified cancellation by the hotel, the customer shall not be entitled to claim damages.

6. Room Availability, Check-In and Check-Out

  1. The customer is not entitled to the provision of specific rooms unless this has been expressly agreed in text form.
  2. Booked rooms are available to the customer from 2:00 p.m. on the agreed arrival date. The customer is not entitled to earlier availability.
  3. On the agreed departure date, the rooms must be vacated and made available to the hotel no later than 10:30 a.m.

In the event of late vacation of the room, the hotel may charge 50% of the full accommodation price (list price) until 2:00 p.m. for use beyond the contractual period, and 100% thereafter.

7. Liability of the Hotel

  1. The hotel shall be liable for its obligations arising from the contract. Claims by the customer for damages are excluded. This exclusion shall not apply to damages resulting from injury to life, body or health where the hotel is responsible for the breach of duty; other damages resulting from an intentional or grossly negligent breach of duty by the hotel; or damages resulting from an intentional or negligent breach of typical contractual obligations by the hotel.

If disruptions or deficiencies occur in the hotel’s services, the hotel will endeavour to remedy them upon becoming aware of them or upon immediate notification by the customer. The customer is obliged to take reasonable steps to assist in remedying the disruption and to minimise any possible damage.

  1. The hotel shall be liable for items brought onto the premises by the customer in accordance with the applicable statutory provisions. Liability is limited to one hundred times the room price, but no more than €3,500. For money, securities and valuables, liability is limited to a maximum of €800. Money, securities and valuables may be stored in the hotel safe up to a maximum value of €3,500.
  2. If the customer is provided with a parking space in the hotel garage or on a hotel parking area, even for a fee, this shall not constitute a safekeeping agreement. The hotel shall not be liable for loss of or damage to motor vehicles, trailers, motorcycles or their contents parked or manoeuvred on the hotel premises, except in cases of intent or gross negligence.
